Privacy Policy

Last Updated: July 2025

Thank you for entrusting Nopmark with your personal information. Nopmark Consulting, LLC (“we”, “us”, or “our”) operates this training website from California, USA. We are committed to protecting your privacy and complying with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) (as amended by the CPRA). This Privacy Policy describes what data we collect, how we use it, your rights, and our practices. By using our website or services, you agree to the collection and use of information as described in this Policy.

Information We Collect

Personal Information You Provide: When you register for a course, make a purchase, or contact us, we collect personal information you provide. This may include your name, email address, billing address, shipping address (if applicable), phone number, payment details, or other contact information needed to fulfill your request. For example, if you purchase a course or product from our site, we will ask for information like your name, address, email, and payment details to process the transaction. If you sign up for our newsletter or marketing communications, we will collect your email and any preferences you express.

Information Collected Automatically: When you browse or use our site, we automatically collect certain data about your device and usage. This includes your computer or device’s Internet Protocol (IP) address, browser type and version, operating system, and browsing actions on our site (such as pages viewed, the time and duration of your visits, and referring URLs). We collect this usage data through cookies and similar tracking technologies to help us understand how users interact with our website and to improve our services. (See “Analytics and Advertising” below for more about cookies.)

No Special or Sensitive Data: We do not collect any special categories of personal data (also known as “sensitive” personal data) about you. This means we will not ask for or intentionally gather information such as your race or ethnic origin, religious or philosophical beliefs, health or medical information, genetic or biometric data, sexual orientation, or information about criminal background. In addition, we do not collect any “sensitive personal information” as defined under California law (such as social security numbers, driver’s license numbers, precise geolocation, or financial account logins). Please do not provide this kind of sensitive information to us, and if we discover that such information has been provided it will be deleted or anonymized.

Children’s Data: Our services are not directed to children. We do not knowingly collect personal information from anyone under the age of 13 (and if you are in the European Economic Area, under 16). If you are under the applicable minimum age, please do not use our site or provide any personal data. If we learn that we have collected personal information from a child under 13 (or 16, as applicable) without parental consent, we will take steps to delete that information. Parents or guardians who believe we might have any information from or about a minor child may contact us to request deletion.

How We Use Your Information

We use the collected personal information for the following purposes:

·      To Provide Services: We use your information to create and manage your user account, register you for courses, process orders and payments, and deliver the training services or products you request. For example, we need your details to enroll you in an online course or to send you course materials and updates.

·      To Communicate with You: We use contact information (like your email) to send confirmations, invoices, technical notices, updates, security alerts, and support messages related to your use of our services. If you have given consent, we may also send newsletters or marketing communications about new courses, promotions, or other updates. You can opt out of marketing emails at any time by using the unsubscribe link or contacting us.

·      To Improve and Personalize our Services: We analyze usage data and feedback to understand how our website and courses are used and to improve the user experience. This includes using analytics to troubleshoot issues, to test and develop new features, and to make our website more intuitive and relevant for users. We may also use aggregated, non-identifiable data to research trends and enhance our offerings.

·      For Analytics and Advertising: We utilize third-party tools (described below in Analytics and Advertising) to understand site traffic and to serve relevant advertisements. This helps us measure the effectiveness of our content and advertising campaigns and deliver content that may interest you.

·      To Ensure Security and Prevent Fraud: We are committed to keeping our platform safe. We may use data (such as IP addresses and usage activity) to monitor for suspicious or fraudulent behavior, detect security incidents, and protect the integrity of our website and users. This includes enforcing our Terms of Service and preventing unauthorized access or activities on our systems.

·      To Comply with Legal Obligations: When necessary, we will use or disclose your information to comply with applicable laws, regulations, legal processes, or enforceable governmental requests. For example, we may process or retain certain data for tax reporting, accounting requirements, or to respond to a court order or subpoena. We may also use and share information as required to exercise or defend legal claims.

We will not use your personal information for any purpose that is incompatible with the original purposes without notifying you. If we need to use your data for a new purpose, we will update this Privacy Policy and, if required by law, seek your consent.

Legal Bases for Processing (GDPR)

If you are an individual in the European Economic Area (EEA) or United Kingdom, we process your personal data only when we have a valid legal basis to do so under GDPR. The legal bases we rely on include:

·      Performance of a Contract: We process personal data as necessary to provide you with our services and fulfill our contract with you. For example, we need to process your name and payment information to enroll you in a paid course or provide customer support that you have requested.

·      Your Consent: In certain cases, we rely on your consent to process your personal data. For instance, if you subscribe to our newsletter or agree to receive marketing communications, we process your email address and preferences based on your consent. You have the right to withdraw your consent at any time, which will not affect the lawfulness of processing based on consent before its withdrawal.

·      Legitimate Interests: We may process your data where it is in our legitimate interests to run and improve our services and those interests are not overridden by your data protection rights. For example, it is in our legitimate interest to use analytics to understand how our website is used, to secure our platform, and to promote our services to users who have shown interest, as long as these activities do not infringe on your fundamental rights and freedoms.

·      Legal Obligation: We process personal data when necessary to comply with a legal or regulatory obligation to which we are subject. For example, retaining transaction records for accounting and tax compliance, or disclosing information when compelled by law.

If you have questions about the legal basis of how we process your personal data, please contact us (see Contact Us at the end of this policy).

Cookies and Similar Technologies

We use “cookies” and similar tracking technologies to collect usage data and improve your experience on our site. Cookies are small text files placed on your device that help us recognize you and remember your preferences. For example, we may use cookies to keep you logged in, remember your language or other settings, and track your interactions with our site. You can set your browser to refuse some or all cookies or to alert you when cookies are being used. However, if you disable cookies, some features of our site may not function properly.

For more information about our use of cookies and how you can manage your preferences, please see our Cookie Policy (if available) or contact us for details. Below, we describe how third-party analytics and advertising cookies are used on our site.

Analytics and Advertising

Google Analytics: We use Google Analytics, a web analytics service provided by Google LLC, to understand how users access and use our website. Google Analytics uses cookies or similar technologies to collect information such as your IP address, browser type, referring pages, and the pages you visit on our site.

This information is transmitted to and stored by Google on servers (which may be in the United States or other countries) and allows us to analyze site traffic and improve our website. Google Analytics provides reports on website activity (e.g., which pages are most visited, how long users stay, and how they arrived at our site). Importantly, Google Analytics may also collect data about your use of other websites over time and can use the collected data to contextualize and personalize ads through its advertising network .

We have enabled Google Analytics advertising features (such as Google AdSense integration, described below), which means Google Analytics may collect additional data via advertising cookies and identifiers. Google may share aggregate analytics data with other Google services and may use it to inform ads on its own ad network. However, we do not receive personally identifying information in these reports – the data is mostly aggregated and used for statistics.

Your Choices: If you do not want Google Analytics to collect data about your website visits, you can opt out. Google provides an Analytics Opt-out Browser Add-on that you can install in your web browser. This add-on prevents Google Analytics from using your information for analytics. You can obtain the add-on and learn more about opting out here: http://tools.google.com/dlpage/gaoptout. For more details on how Google collects and processes data, please see Google’s Privacy Policy .

Google AdSense: We participate in Google AdSense to display advertisements on our website. AdSense is an advertising program by Google that helps website publishers earn revenue by displaying ads tailored to users. We use Google AdSense to serve ads when you visit our site. Google and other third-party advertising partners may use cookies and similar tracking technologies (like web beacons) to collect information about your online activities on our site and other websites over time. This information (which does not include your name, address, email, or telephone number) may be used to show you advertisements for products or services that are likely to be of interest to you based on your browsing history .

For example, if you have visited websites about software testing or e-learning, you might see targeted ads on our site related to software training tools. Google uses the data collected to personalize the ads you see across the web as part of its advertising network. This is called interest-based or personalized advertising. Please note that while we do not share your personal data (like contact info) with advertisers, the advertising cookies on our site may allow advertisers to infer that a user of your browser is interested in certain topics and serve ads accordingly.

Your Choices: You can control how Google and other companies use information collected through cookies for advertising. One option is to adjust your ad personalization settings through Google’s Ads Settings (you will need to be signed into your Google account for this) to disable personalized ads. Additionally, you can opt out of interest-based advertising from many ad networks (including Google) by using industry tools such as the NAI (Network Advertising Initiative) Opt-Out Tool or the DAA (Digital Advertising Alliance) WebChoices Tool. Visiting Google’s “Advertising and Privacy” page can provide more information on how Google uses ad data and the choices available .

Please note that even if you opt out of personalized ads, you may still see ads – they just will not be tailored to your interests. Also, our website may still use other cookies necessary for site functionality, analytics, or non-personalized advertising.

Third-Party Service Providers

We use a variety of third-party service providers to operate our platform and provide our services to you. These providers act on our behalf and may have access to personal information as needed to perform their functions, but they are obligated not to use your data for any other purpose. In general, third-party providers will collect, use, and disclose your information only to the extent necessary to allow them to perform the services we have hired them for. We require our service providers to handle personal information in compliance with applicable privacy laws and this Privacy Policy.

The key third-party service providers we work with include:

·      Thinkific (Hosting and Platform): Our website and online courses are hosted on the Thinkific platform. Thinkific Labs Inc. provides us with the online e-learning platform that enables us to offer courses, process registrations, and run our store. Your data (such as your account information, course progress, and purchase history) is stored through Thinkific’s data storage and databases, and the general Thinkific application on their secure servers. Thinkific stores your data on a secure server behind a firewall. As our hosting provider, Thinkific acts as a data “processor” or “service provider” that processes personal data on our behalf. We have a Data Processing Addendum with Thinkific to ensure your data is handled in line with GDPR and other regulations. For more information, you can review Thinkific’s own Privacy Policy, available at thinkific.com/privacy-policy.

·      Payment Processors: If you make purchases on our site, payments may be processed by third-party payment gateways (for example, Stripe or PayPal, or through Thinkific’s payment system). These payment processors handle your credit card and other payment details securely. Important: When you enter payment information to complete a purchase, that data is encrypted and transmitted directly to the payment processor and is not stored on our servers (though it may be stored by Thinkific’s secure payment infrastructure). All direct payment gateways we use adhere to the Payment Card Industry Data Security Standard (PCI-DSS). PCI-DSS is a security standard managed by the PCI Security Standards Council (a joint effort of credit card brands) that helps ensure the safe handling of credit card information. These payment providers have their own privacy policies which we encourage you to read to understand how they handle your personal information in the context of a transaction.

·      Email and Communication Tools: We may use third-party email service providers or marketing platforms to send newsletters, course updates, or customer support emails. These providers (e.g., MailChimp, SendGrid, or similar services) would process your contact information (like your email address) on our behalf solely to send communications. They are not permitted to use your email for their own marketing. Any such service providers are vetted for strong security practices.

Other service providers we use might include analytics tools, advertising partners (as described in the Analytics and Advertising section), cloud storage or IT support services, and content delivery networks. We only share with them the information necessary for them to perform their services for us, and we contractually bind them to protect your data.

International Service Providers: Some of our third-party providers may be located in or use facilities in different jurisdictions than either you or us. For example, Thinkific’s servers may be located in Canada or the United States, and Google’s analytics and advertising systems operate globally. When your personal information is handled by these providers, it may become subject to the laws of the jurisdiction in which they operate (for instance, data stored by our U.S.-based providers could be accessed by U.S. law enforcement under American law). We take steps to ensure any international data transfers comply with applicable law (see “International Data Transfers” below).

Once you leave our website or are redirected to a third-party website or application (for example, by clicking an external link), this Privacy Policy no longer applies. We are not responsible for the privacy practices of other sites that we do not control, and we encourage you to read their privacy policies before providing any information.

Data Sharing and Disclosure

No Sale of Personal Information: We do not sell your personal information for money or other valuable consideration, and have not sold personal information in the past 12 months. In other words, we do not exchange your personal data with third parties in a way that benefits us beyond the service provided, as defined by applicable privacy laws. This includes that we do not sell the personal information of minors under 16 years of age. We also do not “share” your personal information with third parties for their own cross-context behavioral advertising purposes. “Sharing” in this context means disclosing information about you to a third party for targeted advertising based on your browsing across different websites. We do not engage in such practices. If this ever changes, we will update this policy and provide required opt-out mechanisms.

Service Providers: We may disclose personal information to our trusted service providers and partners who need the information to perform services on our behalf (as described in the section above). For example, we share necessary details with payment processors to complete transactions, or with Thinkific to operate the course platform. These parties are bound by contractual obligations to keep personal information confidential and use it only for the purposes we specify .

Legal Compliance and Protection: We may disclose your information if required to do so by law or legal process, or if we have a good-faith belief that such action is necessary to (a) comply with an obligation, law, or legal request, (b) protect and defend our rights or property, (c) prevent fraud, security, or technical issues, or (d) protect the rights, property, and safety of our users or the public. For instance, we might disclose data in response to a subpoena, court order, or regulatory demand; or report information as necessary to investigate a data breach or cyber incident.

Business Transfers: If we undergo a business transaction such as a merger, acquisition by another company, reorganization, or sale of all or a portion of our assets, your personal information may be transferred to the successor organization. In such cases, we will ensure the confidentiality of any personal information and give affected users notice before personal data becomes subject to a different privacy policy.

Except for the situations described above, we will not disclose your personal data to any unaffiliated third party without your explicit consent. We do not rent or trade your contact information with third-party marketers.

Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes we collected it for, including any legal, accounting, or reporting requirements. For example, we keep your account profile information while your account is active, and for a reasonable period thereafter in case you decide to return to our courses. We retain transaction records as needed for financial audits and tax obligations. If you contact us for support, we may keep records of the correspondence as required to manage our relationship and improve our services.

In some cases, we may anonymize or aggregate your data (so it can no longer be associated with you personally) for statistical analysis or research, in which case we may use this information indefinitely without further notice to you. Once personal data is no longer needed for the purpose for which it was collected, and we are not legally required to keep it, we will securely delete or de-identify it. If you request deletion of your data (see Your Rights below), we will delete your personal information from our active systems and backups as required by law, except to the extent we are permitted or required to retain certain information (for example, to comply with regulatory obligations or to resolve disputes).

Data Security

The security of your personal information is extremely important to us. We implement reasonable and industry-standard security measures to protect your data from unauthorized access, alteration, disclosure, or destruction. This includes administrative, technical, and physical safeguards appropriate to the volume and sensitivity of data we hold. For example, our website uses HTTPS (SSL/TLS encryption) to secure data in transit. If you provide sensitive payment information, that data is encrypted and handled by PCI-compliant services as noted earlier. We regularly review our information collection, storage, and processing practices to guard against unauthorized access and use.

Please understand, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your personal data, we cannot guarantee its absolute security. Cyber threats and software vulnerabilities evolve rapidly, but we continually update and audit our security practices to mitigate these risks. In the unlikely event of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by law.

You are also responsible for maintaining the security of your account credentials (such as your password). Please choose a strong, unique password and keep it confidential. If you suspect any unauthorized access to your account or any security vulnerabilities, notify us immediately so we can assist.

International Data Transfers

We are based in the United States, and the primary location of our business operations is in California. If you are accessing our site from outside the United States, be aware that your personal information will likely be transferred to, stored in, or processed in the United States or other jurisdictions (for example, Canada, where our platform provider Thinkific is located) where our servers and central database are located. This means your data may be transferred to and maintained on computers or systems outside of your state, province, or country, where privacy laws might not be as protective as those in your jurisdiction.

However, we take steps to ensure that adequate safeguards are in place when we transfer personal data internationally, especially for individuals in the EEA, UK, or other regions with data transfer restrictions. These safeguards may include relying on the European Commission’s Standard Contractual Clauses (SCCs) for data transfers, verifying that third-party recipients are certified under frameworks like the EU-U.S. Data Privacy Framework (if applicable), or other legally recognized transfer mechanisms. Our goal is to ensure that your personal information is protected to a standard comparable to the protection provided under your local laws .

By using our services or providing us with your information, you acknowledge the transfer of your personal data to our facilities and to those third parties with whom we share it as described in this policy, including those located in countries other than your own. If you have questions about international data transfers or require more information about the safeguards we have put in place, please contact us.

Your Privacy Rights

We respect your rights to control your personal information. Depending on your location and the applicable law, you have certain rights regarding the personal data we hold about you:

Rights Under the GDPR (for EU/EEA and UK Users)

If you are located in the European Economic Area or the United Kingdom, you have the following data subject rights under the GDPR (and equivalent UK data protection law). Every user is entitled to the following:

·      The Right to Access: You have the right to request copies of your personal data that we hold. This includes the right to obtain confirmation whether we are processing your personal data, and to receive additional details about that processing (such as the purposes, the categories of data, the recipients, and storage periods). We will provide you with a copy of your information in a commonly used electronic format. Note: For additional copies or for manifestly unfounded or excessive requests, we may charge a reasonable fee as permitted by law.

·      The Right to Rectification: You have the right to request that we correct any information you believe is inaccurate or incomplete. We want to ensure your data is accurate and up to date. If you have an account with us, you can also update or correct some of your personal details by logging in and editing your profile.

·      The Right to Erasure: You have the right to request that we delete your personal data, under certain conditions. This “right to be forgotten” enables you to ask us to erase personal information when it is no longer needed for the purposes we collected it, or when you have withdrawn consent or objected to processing and no other legal basis applies. Please note, we cannot delete data where we have a legal obligation to retain it or another lawful basis to keep it (for example, records of transactions may be kept for audit purposes).

·      The Right to Restrict Processing: You have the right to request that we limit the processing of your personal data, under certain conditions. This means we would mark the stored data to be limited in use, for example, while we address a data accuracy dispute or you object to our processing.

·      The Right to Object: You have the right to object to our processing of your personal data, under certain conditions. You can object to processing that is based on our legitimate interests or for direct marketing purposes. If you exercise this right, we will stop processing the information unless we have compelling legitimate grounds that override your objection or if needed for legal claims.

·      The Right to Data Portability: You have the right to request that we transfer the data that we have collected about you to another organization or directly to you, in a structured, commonly used, machine-readable format, where it’s technically feasible and under certain conditions. This right applies to personal data you provided to us, when the processing is based on your consent or on a contract and carried out by automated means.

·      The Right to Withdraw Consent: Where we rely on your consent to process personal data, you have the right to withdraw that consent at any time. This will not affect the lawfulness of any processing that was done before you withdrew consent. If you withdraw consent for marketing emails, for example, we will stop sending them. (There may be cases where we can continue processing on another legal basis, e.g., retaining transaction records for legal compliance.)

·      The Right to Complain to a Supervisory Authority: If you believe we have infringed your data protection rights, you have the right to lodge a complaint with a supervisory authority in the EU/EEA or with the UK Information Commissioner’s Office, as applicable. You can contact the data protection authority in the EU country where you live or work, or where the alleged infringement took place. We would, however, appreciate the chance to address your concerns directly before you do this, so please consider reaching out to us first.

You can exercise any of these rights by contacting us (see Contact Us below). We may ask you to verify your identity before fulfilling your request, to ensure that we do not disclose your data to an unauthorized person. We will respond to your request within one month, or inform you if we need an extension of time as permitted by law. There is no fee for exercising your rights unless the requests are repetitive or excessive, in which case we may charge a reasonable fee or refuse the request as allowed by law.

Rights of California Residents (CCPA/CPRA)

If you are a California resident, you are entitled to certain rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). These rights (subject to certain exceptions and limitations) include:

·      Right to Know: You have the right to request that we disclose what personal information we have collected, used, disclosed, or shared about you over the past 12 months. This includes the categories of personal information collected, the categories of sources, the business or commercial purposes for collection, the categories of third parties with whom we shared personal information, and specific pieces of personal information we have collected about you. Essentially, you may request a copy of the specific personal data we have about you, as well as additional details about our data practices. This is similar to the “access” right described under GDPR.

·      Right to Delete: You have the right to request that we delete personal information we collected from you and retained, subject to certain exceptions. Once we receive and confirm a verifiable consumer request, we will delete (and instruct our service providers to delete) your personal information from our records, unless an exception applies. California law permits retention of data in certain cases – for example, we may retain information needed to complete a transaction you requested, to detect security incidents or protect against illegal activity, to comply with a legal obligation, or other reasons allowed by CCPA 57. If we deny a deletion request, we will inform you of the reason.

·      Right to Correct: You have the right to request that we correct inaccuracies in your personal information, taking into account the nature of the information and the purposes of processing. If you become aware that we hold incorrect or outdated information about you, please contact us with the correction request. We will take appropriate steps to verify and correct the information as needed (or let you know if we cannot fulfill it, for example if the request is manifestly unfounded).

·      Right to Opt-Out of Sale or Sharing: You have the right to opt out of the sale of your personal information to third parties, and the right to opt out of the sharing of your personal information for cross-context behavioral advertising. However, as noted above, we do not sell personal information, and we do not share your personal information for targeted advertising purposes in the sense defined by California law 37. Because we do not engage in selling or sharing of personal data in this way, we do not offer a “Do Not Sell or Share My Personal Information” link at this time. If our practices change, we will update this Policy and provide applicable opt-out mechanisms on our website.

·      Right to Limit Use of Sensitive Personal Information: The CPRA provides California consumers the right to limit the use and disclosure of “sensitive personal information” (e.g. precise geolocation, race/ethnicity, health data, etc.) if a business uses it for reasons other than those permitted. In our case, we do not collect or use sensitive personal information in a manner that triggers this right (we do not collect such data at all, as mentioned in Information We Collect). Therefore, this right is not applicable to our services at this time. Should that change, we will provide a method to exercise this right.

·      Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means that if you choose to exercise your privacy rights, we will not deny you our services, charge you a different price, or provide a different level or quality of services just because you exercised your rights. The CCPA prohibits businesses from retaliating or discriminating in this way. Unless permitted by the CCPA, we will not (for example) deny you goods or services, charge you different prices or rates, or suggest that you may receive different prices or quality of services because you exercised your rights.

Exercising Your California Privacy Rights: If you are a California resident and wish to exercise the right to know, access, delete, or correct your personal information, you (or an authorized agent acting on your behalf) may submit a verifiable request to us. Please see Contact Us below for how to reach us by email or mail. In your request, please specify which right you seek to exercise and provide sufficient information that allows us to verify you are the person about whom we have collected personal information (for example, by providing identifying details we may already have, such as your email address used on our site). We will only use the information you provide in a request to verify your identity or authority. We will respond to verifiable consumer requests within the timeframe required by law (generally within 45 days, with the possibility of an extension by an additional 45 days with notice). If we need additional information to verify your request, we will let you know.

If you have an authorized agent submitting a request on your behalf, we may require proof of the agent’s authorization (such as a written permission from you or a power of attorney) and verification of your identity directly.

For opt-out of sale/sharing requests: as noted, we do not sell or share personal info under CCPA definitions, but if you still have questions or want to ensure your data is not inadvertently sold/shared, you can also contact us.

We hope the above clarifies your rights. If you have any questions about your privacy rights or need assistance, please contact us.
